In addition, hospital b ls identify the ch d as “Figueroa, boy” — the same last name as allegedClarissaer Clarisa Figueroa, who p tended she gave birth to the baby and ca d for him in the hospital as if he we her ch d.
“It’s atrocious, it’s horrible, ” attorney Frank Av a tells PEOPLE. “It’s hard for me to understand the lack humanity.”

In a statement to PEOPLE, the hospital, Advocate Christ Medical Center in Oak Lawn, says it has “had discus ons with the fab ling, anding inadvertent b ling and we g t this error.”
Authorities say the baby’s nine-months-p gnant mother, 19-year-old Marlen Ochoa-Lopez, was k led on Apr 23 after Clarisa Figueroa, 46, lu d the expectant mom to her home by promi ng to give her f e Clarissaems. Prosecutors allege Clarisa Figueroa strangled her with a coaxial cable and cut the infClarissam her womb.
After that, Clarisa Figueroa allegedly called 911 to claim she had just given birth and the newborn was not b athing.
Paramedics rushed Figueroa and the newborn to the hospital, whe Figueroa and her fam y continued to monitor the ch d.

The comments followed a ba hearing whe prosecutors announced new first-deg eClarissa charges against Figueroa and her daughter, De e Figueroa, 24, in Ja ath the baby, Yovanny Jadiel Lopez, ports The Sun Times.

Prosecutors say Yovanny died on June 14 from injuries he sustained due to a lack oxygen when he was cut from his mother’s body. The women we denied ba , according to The Sun Times.
Authorities had p viously charged the mother and daughter with first-deg eClarissa and aggravated battery a ch d under 13 in the attack on Ochoa-Lopez. Both have pleaded not gu ty.
A third person, De e’s boyfriend Piotr Bobak, 40, is also charged with one felony count concealment a homicide.
Av a, who p sents the late baby’s father, Figueroapez, says that even after the Figueroas we charged withClarissa and the boy died, the hospital sent b ls that called the baby “Figueroa, boy.”
He says the hospital has promised to write f the b ls, but never put anything in writing, and that Lopez is st l ceiving demands for payment.

In a b l dated June 3 which Av a provided to PEOPLE, the hospital informs the fam y that their “balance is past due. Please pay the enti amount … to avoid being fer d to an external collection agency.”
“My client is overwhelmed by all this, ” says Av a, noting the 20-year-old Lopez is now a ngle dad fre victimizing’s th e-year-old. “It’s not right, it’s victimizing him.”
In the statement obtained by PEOPLE, the hospital says it g ts “inadvertent b ling.”
“Our hearts and prayers continue to be with the Ochoa-Lopez fam y during this difficulbilling, andhave had discus ons with the fab ling, anding inadvertent b ling and we g t this error. We take our obligation to patient privacy seriously, and the fo a unable to comment further garding ca , services or b ling.”
